Genetic Designs LLC ("Genetic Designs," "we," "us," "our") is a Texas limited liability company. This Privacy Policy explains how we collect, use, and share information across our products and services, including the Horta plant-care application and website (horta.app), the 3D Genetic Designs storefront (3dgeneticdesigns.com), and this website (geneticdesignsllc.com) — together, the "Services."

2. Information we collect

• Account information: your name, email address, username, and authentication details, including when you sign in through a third-party sign-in provider you choose. Passwords are handled securely through our authentication provider.
• Profile and preferences: display details, climate or hardiness zone, hemisphere, and notification settings.
• Plant and care data: plants you add, care logs and history, reminders, notes, locations you assign to your plants, and photos you upload.
• Tag data: when you scan or claim an NFC or QR tag, the tag identifier and related claim or transfer activity.
• Store information (3D Genetic Designs): order details, shipping address, and contact information. Payments are processed by our third-party payment processor; we do not store full payment card numbers.
• Usage and device data: interactions with the Services, device and browser type, IP address, and diagnostic or error data.
• Communications: messages you send us, such as support requests.

3. How we use information

We use information to provide and operate the Services; create and manage your account; deliver care reminders and notifications; fulfill and ship store orders; provide customer support; improve and secure the Services; detect and prevent fraud or abuse; and comply with our legal obligations.

4. Public content

Some features let you make content public — for example, public plant cards, public collection profiles, and brand or grower profiles. Information you choose to make public may be viewable by anyone with the link. Private details, such as plant locations and private notes, are not included in public-facing views.

5. How we share information

We do not sell your personal information. We share information with:

• Service providers who help us run the Services — including hosting, database and authentication, error monitoring, email delivery, push notifications, analytics, and payment processing. These currently include providers such as Supabase, Vercel, Sentry, and Resend, along with a payment processor for store orders.
• App platforms (Apple and Google) as needed for app distribution and push notifications.
• Legal and safety purposes, when required by law or to protect rights, safety, and the integrity of the Services.
• Business transfers, in connection with a merger, acquisition, or sale of assets.

6. Cookies and analytics

We use cookies and similar technologies, along with analytics tools (such as Vercel Analytics), to operate the site and understand usage. You can control cookies through your browser settings.

7. Data retention and deletion

We retain information for as long as your account is active or as needed to provide the Services. We use soft-deletion for certain records so information can be removed from view and then deleted in the ordinary course. You may request deletion of your account and associated data by contacting privacy@geneticdesignsllc.com.

8. Your rights and choices

Depending on where you live — including under the EU/UK GDPR and California's CCPA/CPRA — you may have rights to access, correct, delete, or port your information, and to object to or restrict certain processing. To exercise these rights, contact privacy@geneticdesignsllc.com. You can also manage notifications in your account settings and adjust device permissions, such as camera and NFC access, in your device settings.

9. Security

We use reasonable technical and organizational measures to protect your information. No method of transmission or storage is completely secure, and we cannot guarantee absolute security.

10. Children's privacy

The Services are not directed to children under 13, and we do not knowingly collect personal information from children under 13. If you believe a child has provided us information, please contact us and we will take appropriate steps.

11. International users

We are based in the United States and process information there. If you access the Services from outside the United States, you consent to the transfer and processing of your information in the United States.

12. Changes to this policy

We may update this Privacy Policy from time to time. We will post the updated version here and revise the "Last updated" date above.
